Oklahoma's Fit Kids Act of 2004

On January 22, 2003, the Fit Kids Coalition held a media conference at the State Capitol to announce its objectives. A specific legislative agenda was presented, targeting passage in the upcoming session:


1. Physical Education

For Grades K-8, establish a minimum weekly statewide fitness education requirement: 150 minutes of physical education and 60 minutes of health/nutrition education.
Set a minimum level/duration of exertion/cardio strength training.
Define four health/nutrition education components as nutrition/obesity prevention, cardio health, tobacco prevention and injury prevention.
Establish enforcement of physical education requirement.
Implement a program of fitness testing to include standardized data collection measurements as defined by the Oklahoma State Department of Health and professional development training for the implementation of these tests.

2. Nutrition In Schools

In elementary and middle school vending machines, replace unhealthy beverages and snacks with healthy options.
To distinguish “healthy” from “unhealthy” items, use the USDA definition used for school cafeteria meals.
In high school vending machines, provide incentive pricing for healthy options (less expensive than unhealthy).
Require public disclosure of all current soft drink contracts. Any contracts signed after the passing of this legislation must follow these nutrition guidelines.

3. School Health Councils

Combine a Health Advisory Committee at each school with the already existing Safe School Committees, mandated by the legislature. These new councils would be known as the Safe and Healthy School Councils and must include the school nurse and physical education teacher.
Provide for positive incentives (financial) to reward schools that do well. Progress to be monitored by the Oklahoma State Department of Education.

4. Identify Funding Sources

Lottery: Earmark fund for healthy changes at school.
Tobacco Tax: Allocate a portion to promote healthy changes.
